1. Coverage.
Applied Membranes, Inc. (“AMI”) warrants to the original purchaser that products manufactured by AMI will be free from defects in materials and workmanship under normal use and service for three (3) months from shipment of the products to said original purchaser . For consumable components (including membranes and filters), normal wear, depletion, fouling, or replacement at the end of the stated service life is not a defect and is not covered. Products not manufactured by AMI are covered, if at all, only by the original manufacturer’s warranty; this Limited Warranty does not limit any rights you may have under applicable law.
2. Exclusions.
This Limited Warranty does not cover:
(a) repairs or alterations made without AMI’s prior written authorization;
(b) damage or performance degradation resulting from inlet water outside the published specifications or required pre‑filtration;
(c) biofouling, scaling, or plugging due to suspended matter, precipitates, or biological growth where such conditions exceed published operating limits;
(d) improper installation, use, storage, or maintenance;
(e) normal wear of consumables; or
(f) damage from accident, abuse, misuse, fire, flood, or other external causes.
3. Remedy.
If a covered defect is confirmed, AMI will, at its option, repair or replace the defective product or part, or refund the purchase price if repair or replacement is not commercially practicable. For approved claims, AMI will bear reasonable shipping costs for returns and replacements. If repair or replacement cannot be completed within a reasonable time, you may be entitled to a refund or replacement as required by law.
4. Implied Warranties.
TO THE EXTENT REQUIRED BY LAW, ANY IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE EXPRESS WARRANTY PERIOD ABOVE . Some states do not allow limitations on implied warranties, so this limitation may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMI IS NOT LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, OR CONSEQUENTIAL DAMAGES. IN NO EVENT WILL AMI’S AGGREGATE LIABILITY EXCEED THE AMOUNT PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LEGALLY BE LIMITED, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY OR DAMAGE TO TANGIBLE PROPERTY PROXIMATELY CAUSED BY AMI’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
6. No Tie‑In.
Use of non‑AMI replacement filters or membranes will not by itself void this Limited Warranty; however, replacements must meet the product’s specifications.
7. Warranty Service.
To obtain service, contact AMI at Sales@AppliedMembranes.com for a Return Material Authorization (“RMA”) and instructions. Proof of purchase may be required. Do not return any product without an RMA.
8.Transferability; Territory.
This Limited Warranty applies only to the original purchaser. You may have additional rights that vary by your jurisdiction.
9. Permits and Compliance.
You are responsible for obtaining any permits and inspections and for complying with applicable codes and regulations for installation and use.
